I have been on the panel of mediators for the U.S. District Court for the Northern District of California since 2001. I have mediated a number of cases for the Northern District through its ADR Program involving the areas of insurance coverage and bad faith, contractual disputes, and claims for personal injuries.

I attended the Introductroy Mediation training Program put on by the U. S.District Court for the Northern District of California on October of 2001. I have also attended numerous seminars and brown-bag lunch mediation group sessions put on by the Northern District ADR Program coordiantor during the past five years. I have also participated as an attorney in literally hundreds of mediations throughout my 25-year career in the area of insurance, personal injury, breach of contract, legal malpractice, product liability, and construction cases.

I was trained as a neutral evaluator through the training program for Early Neutral Evaluators put on by the U. S. District Court for the Northern District of California in September 2001. I have also provided neutral evaluation for the Northern District through its ADR Program in the areas of insurance coverage and bad faith, cotnractual disputes, and personal injury claims.

Mediation
Approach:


 
Generally, I assist the parties in reaching common ground upon which a resolution can be achieved. This is considered a facilitative approach where the parties are the prime movers in achieving a settlement with assistance of the mediator. However, I have also utilized a directive approach wherein the mediator is actively involved in evaluation the respective positioins of the parties with respect to liability and damages. However, an opinion concerning liability or damages is not given by the mediator unless expressly requested by either a party or parties.

Approach:


 
Generally, I have a direct/evalautive style with respect to neutral evaluation. I request that the parties provide written submissions regarding their respective positions on both liability and damages. Then, after reviewing and analyzing the statements, I will meet with the parties in a joint session and will allow them to each provide oral presentations regarding their respective positioins and will then ask questions of the parties as well as their counsel. I will then recess the session for a brief period (20 - 25 minutes) and will complete my evaluation. I will then meet with the parties again in a joint session and will orally give them my assessment of both liability and damages and will follow it up with a written report confirming my evaluation in this regard. The evaluation is generally definitive, advising of my opinion concerning liability as well as the potential range of damages with regard to both settlement and verdict.
