Mediation Approach:
Unlike in trials and arbitrations, I believe that the parties should be allowed to participate and feel that they have a say in the process. I usually begin with a facilitative/directive approach and then, as needed, I shift to a more directive approach. I am amenable to counsel's agreed approach also.
Arbitration Approach:
I try to create a somewhat informal hearing environment, relaxed approach to evidence (unless counsel want a strict approach) and I follow the law. I have no difficulty in calling it as I see it as opposed to "splittign the baby".
