Mediation Approach:
I will tailor my approach to whatever method is required by the parties or to resolve the dispute. I expect to start most mediations in a facilitative fashion; while many are resolved in this mode, others are best resolved when I take a more evaluative/directive role with the individual parties. Whichever method is utilized, it is ultimately the parties that will decide how and when to resolve their dispute.
Arbitration Approach:
Unless agreed otherwise, evidence received as it would be in Court and any decisions are made based on the law and evidence presented, based on what I believe a local judge or jury would decide.
Neutral Approach:
I consider all facts and factors, ask questions of and challenge the participants regarding potential outcomes, and inform parties of my view based on these and my experience.
