Mediation
Experience:

I have two primary areas of mediation expertise: pre-litigation mediation of business disputes and mediation of disputes amongst public entities, figures and/or private parties.

Regarding pre-litigation mediation of business disputes, I focus on (a) securities, investment and valuation disputes; (b) company and partnership ownership and operation issues; (c) contractual disagreements; and (d) intellectual property disputes. I have honed this expertise through my experience as a mediator, decades of private business practice, as general counsel for an international trade association that includes Disney and Universal Studios and as a certified NFL agent.

Regarding public disputes, I have perfected my skills through my experience as a mediator and as an advisor to national figures, governors, mayors, legislators and other public officials and private parties.

Mediation
Approach:

There is nothing I find more rewarding as an attorney than helping parties resolve disputes. I believe this perspective permeates my sessions and is a major reason my disputes settle. Successful mediation also is directly related to thorough preparation. My goal is to walk into the mediation with a comprehensive understanding of the issues, the views of the clients, the arguments of the attorneys and an agreement as to how we initially will proceed.

In the early rounds especially, I tend to listen much more than I talk. However, at the very beginning I usually make it clear to the parties exactly what is at stake if we are not able to resolve the dispute through mediation. After that my role is determined by what is most appropriate to keep things moving towards resolution.
