Mediation
Experience:

Extensive experience in mediation as an advocate, including individual and group ("Class") grievances, interest grievance, breach of contract and contract enforcement cases.

Mediator, San Mateo County Small Claims ADR Panel since 2016. Cases successfully mediated include breach of contract, construction, employment matters, landlord/tenant (both residential and commercial), personal injury, etc.

Assisted National Mediation Board in developing a "state of the art" online grievance/dispute mediation program which has resulted in the resolution of thousands of grievances in the railroad and airline industries. I have taught courses in negotiation, ethics and ADR for the Practising Law Institute (and other attorney continuing education providers) in California, District of Columbia, Texas, New York and elsewhere.
Mediation
Training:

UC Hastings 40-Hour Mediator Training Program, June 2016. Participant in annual NorCal Mediation Conference since 2016. Member, American Bar Association ADR Section. Regular participant in ABA Alternative Dispute Resolution Section programs.
Arbitration
Experience:

Extensive experience (approximately 200 cases) as a "first chair" advocate in grievance arbitration, including both individual grievances (wrongful termination, discipline, harassment, discrimination, wage/hour disputes, etc.), and grievances affecting entire employee groups or classes (including "high-dollar" contract interpretation/interest arbitrations, wage claims, etc.).

I spent eleven years representing management, followed by eighteen years as a Union attorney.
Neutral
Evaluation
Background:

Frequently asked by lawyers and law firms to review pending and potential cases, and offer a neutral evaluation.
Settlement
Conference
Experience:

Participated in numerous settlement conferences (mandatory and optional) over my 30-plus year career as an advocate.

Other
Education:

J.D., University of California Hastings College of Law
Mediation
Approach:

I endeavor to create an atmosphere of mutual respect and open, honest communication. I work to dee-fuse emotions and encourage both parties to "go to the balcony" and take a broad view of the dispute. I typically use a facilitative approach, which is typically most effective in cases involving intense emotions or where preservation/re-establishment of the relationship may be of concern. The needs of the parties and the specific nature of the case will determine the approach. Whether facilitative, evaluative (or even "transformational"), the goal is to generate useful information and informed decision-making, thereby promoting a reasonable settlement (or at least a narrowing of the issues in dispute).

Arbitration
Approach:

My goal in arbitration is to conduct an efficient hearing, maintaining an atmosphere of professionalism, impartiality and respect for all participants. I endeavor to conduct a fair hearing, and issue a timely and well-reasoned award.
Neutral
Approach:

Based upon my nearly forty years of legal and business experience including over ten years representing management and operating a large business, prior to a nearly twenty-year period representing unionized employees - I bring a unique perspective to employment and business disputes. I have often been able to point out potential strategic and/or evidentiary issues which an advocate or party to the dispute might have ignored or minimized. I strive to present a logical and well-reasoned evaluation.
Other
Information:

In employment matters, I offer a unique perspective—having both management and union/employee experience. Having owned and operated a substantial manufacturing business, with employees represented by five separate unions, followed by nearly twenty years as a senior union attorney, I am able to offer a nuanced view of business disputes and employment matters.

Retired in 2016 as Senior Labor Relations Counsel, Air Line Pilots Association, International

2006—present, Adjunct Professor of Law, UC Hastings College of Law: Instructor in courses on negotiation and settlement.

Frequent presenter on negotiation techniques, ethics and alternative dispute resolution at Bay Area law firms, business schools and corporations.
