Mediation Approach:
Through my experience as a mediator and attorney, I understand that civil litigation is often engaged for reasons beyond the underlying dispute. I assist the parties in analyzing their respective positions, and take an evaluative/directive approach in helping the parties better assess risk. I actively listen to them and facilitate discussion, thereby moving the parties towards a cost-effective resolution.
Arbitration Approach:
Arbitration hearings are handled much like bench trials, following industry and/or jurisdiction-specific rules (e.g., construction, employment, Realtor, bar assoc., etc.). Submission of briefs and evidence required. Arbitration awards include formal statements of decision.
