Mediation Approach:
I try to take an approach suitable to the needs of the parties. I am neither exclusively facilitative nor directive, but try to identify an approach that will move the matter toward resolution.
Arbitration Approach:
I believe my role in arbitration is to make a decision based on the evidence presented. I do not believe it is my function to find a compromise result or to "split the baby". Rather, I believe it is my function to make whatever decision is indicated by the law and the facts presented.
Neutral Approach:
I follow the general guidelines of the Federal Court. I review briefs, listen to presentation of evidence and argument by counsel, prepare and deliver an award, and then follow-up with settlement discusssions, discussion on necessary discovery, and the like.
