I am one of the founders of the law firm of Niven & Smith, and since 1977 have maintained a multi-faced civil litigation practice in the areas of real estate, complex construction defect, professional malpractice, securities and consumer class actions, commercial leasing and product liability. In this period, I have additionally served as Judge Pro Tem and court-appointed referee in the San Mateo and San Francisco County Superior Courts, and have been a member of continuing education panels in the areas of residential home defect litigation, real estate, brokerage litigation, damages and remedies in real estate litigation and elder abuse.
Since 1999, I have also maintained an active mediation practice. My training includes Mediation and Conflict Resolution training (40 hours) and American Arbitration association arbitration training (10 hours). In the course of my mediation practice I have assisted parties in reaching settlements in matters involving real estate sales contracts, real estate broker and mortgage broker claims, partition and specific performance action, sales of business opportunities, partnership dissolution, attorney-client fee disputes, commercial contract claims, commercial leasing disputes, complex construction defects in both residential and commercial properties, and real estate non-disclosiue actions.
